Welcome to PicGen. These Terms of Service ('Terms') govern your use of our AI image generation service, including our website, applications, and all related services (collectively, the 'Service'). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that your use of the Service does not violate any applicable law or regulation.

When you create an account with us, you must provide accurate and complete information. You are responsible for maintaining the security of your account and password, and you agree to accept responsibility for all activities that occur under your account.

Our Service allows you to generate, post, and share content. By providing content to the Service, you agree that:

• The content does not violate the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights
• The content does not violate any applicable laws or regulations

The Service and its original content, features, and functionality are and will remain the exclusive property of PicGen and its licensors. You may use images generated through our Service for personal and commercial use, subject to the limitations specified in these Terms.

You agree not to use the Service for:

• Creating, generating, or sharing content that is illegal, defamatory, obscene, pornographic, or otherwise objectionable
• Impersonating others or providing inaccurate information
• Creating or submitting unwanted content, including spam or harassment
• Interfering with or bypassing measures of the Service designed to prevent or restrict access
• Attempting to access areas of the Service beyond your authorization
• Exploiting the Service for malicious purposes or in ways not intended

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

Your use of the Service is at your sole risk. The Service is provided on an 'AS IS' and 'AS AVAILABLE' basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

In no event shall PicGen, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

These Terms shall be governed and construed in accordance with the laws applicable in the jurisdiction where PicGen operates, without regard to its conflict of law provisions.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
